What Does “Subrogation” Mean in Regard to Health Insurance?

If your health insurance pays for your medical treatment that is related to a car accident caused by someone else’s negligence, they can later ask to be paid back out of your settlement. This is called a subrogation interest. It’s a reimbursement to your health insurance company for the costs of your medical treatments after an injury.

When you have health insurance such as Medicare, Medicaid, or Tricare, we are required by law to notify them that you were involved in an incident in which you were injured and that they may or may not have paid out for medical bills as a result.

However, when you have private health insurance, your lawyer has no such duty to notify your health insurance carrier. Common private health insurance companies include Blue Cross Blue Shield, Aetna, Cigna, United Healthcare, and others. The difference is that you do not always have to pay back your private health insurance providers for the medical bills you incur from a wreck. The only time you pay back your medical insurance provider is if they put you or the law firm on notice, and if they do so before we’ve disbursed your settlement amount.
