A well-crafted demand letter is vital to a successful injury claim – but what exactly is it? Joel Hudson, founder and attorney at Carrollton Injury Law explains in this video.
What Goes into a Demand Letter
A demand letter is sent by your personal injury lawyer when you’re done being treated for your injuries. At Carrollton Injury Law, our demand letters are very detailed, usually at least eight pages or longer, with all the medical records, bills, photographs, and other supporting documents attached to it.Â
You will get a copy of your demand letter before we send it. We like our clients to look at that and let us know if anything needs to be changed, or we can always do a supplement for the demand letter if needed.Â
In the demand letter you are going to see a very large number that we’re demanding on your claim. It’s important to understand that that’s a number to get the ball rolling on negotiations. It’s usually not a number that you should expect for us to get in a final settlement. It is a negotiation process, so we like to let our clients know that up front.
Getting a Response from the Adjuster
In your demand letter, we ask for a reply within two weeks. From experience, we know the adjusters are going to get upset with us if we ask for a shorter period of time. We don’t want to upset an adjuster since they’re holding the purse strings on your claim, but we do give them at least two weeks so they can comb through all the records and bills themselves and visit with their boss about the offer they’re going to make for your claim. From there, the negotiation process starts.
