It is illegal to be unbuckled in your seat whether you are in the driver’s seat, passenger’s seat, or back seat. Fines for Not Wearing a Seatbelt
Punishment for not wearing a seatbelt in a moving vehicle can be up to $200. If a child under the age of 8 is in the car and not properly restrained in a car seat, the fine can be up to $250 plus court fees.

Airbags are designed to work with seatbelts, not instead of them. In a wreck, the seatbelt keeps you from flinging into the airbag at a high speed by tightening and restraining you in your seat.
