If you are in a pedestrian accident where you were hit by a driver without insurance, you most certainly can make an uninsured motorist (UM) claim as long as you have uninsured motorist coverage. If you do not have a UM policy, but you are living with someone who has a policy, even if you are not on it, you can file an uninsured motorist claim under their UM coverage.

Whether you have a vehicle, don’t have a vehicle, are of driving age or are not of driving age, as long as you were hit by a car, and you were not at fault, you can file a UM claim against your policy or the policy of the person with which you are living. You do not have to have been inside a car at the time you were hit by a car to make a claim on an auto policy.
